Under the Real Estate (Regulation and Development) Act, 2016, is a legal requirement for builders, developers, and real estate agents in India. It aims to bring greater transparency, accountability, and efficiency to the real estate sector. If you’re planning to launch a new residential or commercial project, or operate as a real estate agent, obtaining RERA approval is essential. The registration process helps protect homebuyers’ interests and builds trust by ensuring timely project delivery and accurate disclosures.

  1. PAN card of the company/individual
  2. Project details (name, location, layout plan, development plan)
  3. Ownership/land title deed
  4. Approvals from local authorities (sanctioned plans, commencement certificate)
  5. Estimated project cost and timeline
  6. Architect and engineer details
  7. Previous project history (if any)
  1. PAN card and Aadhar card
  2. Business registration proof (Partnership deed, MOA/AOA, etc.)
  3. Office address proof
  4. Photograph of the agent
  5. Income tax returns (last 3 years)
  1. Visit the respective state RERA portal.
  2. Create an account and choose promoter/agent registration.
  3. Fill out the application form with project or agent details.
  4. Upload required documents in specified formats.
  5. Pay the registration fee (varies by state and project size).
  6. Submit the application and note the reference number.
  7. Get the RERA registration number once approved (usually within 30 days).

RERA registration is mandatory for projects exceeding 500 sq. meters or more than 8 apartments. Exemptions include projects below these thresholds, renovation/repair projects (no new sales), and projects with occupancy/completion certificates issued before RERA came into effect.

Both real estate agents and promoters/developers must register under RERA for facilitating or engaging in transactions for RERA-registered projects.

Promoters/agents must apply for renewal before expiry, typically 60 days to 3 months in advance, submitting updated documents and paying renewal fees. Extensions are granted for valid reasons like force majeure, subject to RERA authority approval.

Builders/promoters can modify the project plan only with the consent of two-thirds of allottees and approval from the regulatory authority.

If RERA does not communicate approval or rejection within 30 days of a complete application, registration is automatically deemed granted.

Only with prior written consent from two-thirds of allottees and approval from RERA authority, a project can be transferred to another promoter under Section 15.
